I got a DUI last night, now what?
“If this is your first offense, you will be required to surrender your driver’s license but if you request a DMV (Department of Motor Vehicles) hearing immediately they will issue you a temporary license. This will buy you some time to get your affairs in order because the hearing will be weeks out. Also, you will be required to appear at county court at which time the DA (District Attorney) will speak with you and most likely make a plea offer which you can accept or take your case to trial. Every DUI is different and there are so many variables how your case will proceed and what plea you may receive. If you take a plea you will be on probation, need to take an alcohol evaluation and preform the recommendations which include classes, you will need to complete the required number of hour for public service, pay a lot of fines and fees, and attend a MADD panel. Depending on mitigating circumstances at sentencing all of these requirements will vary. If there were injuries or other aggravating factors there may be more requirements, including jail time.”
Can I defend myself?
“You can defend yourself in any court action. You will be expected to know your rights, the law, and procedure. Hiring an attorney will add to your costs but you will be represented which may actually save you a little money going against zealous DAs.”
